a) Ancestry, co.uk: UK, Extracted Probate Records: Coull, Patrick, late merchant in Cullen 23/11/1784. Book: Mort Roll from 1781 in the Register House, Edinburgh. (Death). b) Scotlandspeople website: 1 Cull Patrick 23/11/1784 late merchant in Cullen. Aberdeen Commissary Court. His executrix was his daughter, Jean Coull, and her ‘Cautioner’ at the auction was Alexander Coull. His creditors had to be paid out of the proceeds.

of the Means and Effects, which pertained to the deceased Patrick Coull, late Merchant in Cullen at the time of his death, which happened the End of April last, Made and Given up by Jean Coull, Eldest daughter of the said defunct, and Exerix decerned to him,

By and before the Commissary Aberdeen, upon the sixth day of August last, confirm to the Decrees of Executry pronounced thereanent; Under protestation that the said Exerix, shall be no further liable, than to the extent of the Sum to be given up in Inventory;

That she shall have retention and allowance of the Expence of this confirmation, of the defuncts funeral Charges and Expences, and of all other, preferable and priviledged Debts; And that she shall be at liberty, to add and eik to this present Inventory such Effects, as may afterwards come to her knowledge –

Under these protestations, the said Exerix Grants and Confesses, that there pertained to the said defunct, some Merchant Goods, household furniture and other Effects, and which were in his possession, at the time of his death, and were by public roup sold by the said Exerix the Eighteenth day of August last, in virtue of a warrand from the said Commissary, of date the sixth day of the said

At Aberdeen the twenty third day of November……and Eighty four (will mean 1784) in presence of Alexander Innes Esquire of ?Breday Commissary of Aberdeen –

The Commissary aforesaid confirms the said Jean Coull Exerix decerned to and nearest in kin of the said defunct. Approves of the foregoing Inventory and hereby Grants full power and authority to her to ?imbromitt with the Sum of money before given up and hath received Alexander Coull Taylor in Cullen as ?Cautioner for her, that the sum of money before mentioned, shall be made furthcoming to all Parties having interest therein, as Accords of the Law And the said Exerix and Cautioner, submitt themselves to the jurisdiction of the Commissary of Aberdeen in all matters and questions relative to the said ?Exerix, and affix the Commissary Clerks in Aberdeen as a domicile for laying on all citations against them thereanent, in case they, or either of them shall happen at any time hereafter to live without the said Commissary’s jurisdiction –

Page 5 Articles & Conditions upon which Sundry Articles, Merchant goods, Household furniture, & ?… Corns, lately the property of the deceast Patrick Coull late Merchant in Cullen, now belonging to his Creditors, are to be disposed of by Publick Roup for ?behoofs of his said Creditors by virtue of a warrand from the Commissary of Aberdeen of date 6th August, current at Cullen this eighteenth day of August one thousand and seven hundred and Eighty-four years.

Article:
1st – Every Article will be put up at the discretion of the Judge of the Roup when among the offers made the last and highest Bidder will be preferred upon the following Conditions ? Allenarly.

2nd – Every Article is to be ready money.

3rd – As every Article becomes the property of the Purchasers however soon the same is struck out in their favours, it is to be at their risque from that time; and be removed from the place of Roup immediately after satisfying the Judge in terms of the foregoing Article.

4th – If any Purchaser fail in payments, agreeable to the preceding Articles, They are hereby declared to be lyable to the Exposer in one fifth part of the Value struck out in their favours, and the article set up again or given to the next highest bidder, in the Judge’s Option.

5th – In the course of making offers at the Roup, every offer must exceed the preceding offer, in two pence above twenty shillings, sixpence above Forty Shillings, and one Shilling above four Pounds Stirling.

6th – George Jamieson in Fordyce whereby appointed Judge of the Roup, with full power to determine all Difference that may arise thereat, to whose Determination all parties, etc.
